1. Introduction

Welcome to Surfspots.net ("the Platform"), a community-driven watersports spot mapping service operated by Dungeon Studio Solutions ("we", "us", "our").

By accessing or using the Platform, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Platform.

2. Definitions

  • "User" — any registered account holder
  • "Visitor" — anyone who browses the Platform without an account
  • "Spot" — a watersports location submitted by a User
  • "Business Listing" — a paid commercial entry on the map
  • "Submission" — a spot or business listing request sent for review
  • "Approved Content" — content reviewed and published by us
  • "Pending" — a submission awaiting review

3. Eligibility

To use the Platform you must be:

  • At least 16 years old (EU/UK) or 13 years old (USA, with parental consent)
  • Capable of entering a binding agreement
  • Not prohibited from using the service under applicable law

By registering, you confirm that you meet these requirements.

4. User Accounts

4.1 Registration

Account creation requires a valid email address via our authentication provider (Clerk). You are responsible for keeping your login credentials secure.

4.2 Account Responsibility

You are responsible for all activity under your account. Do not share your account. Notify us immediately at surfspots.contact@gmail.com if you suspect unauthorised access.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, without notice in cases of serious or repeated violations.

5. Spot Submissions (Free)

5.1 Free Service

Submitting watersports spots is free of charge for all registered Users.

5.2 One Pending Submission at a Time

A User may have only one spot submission pending review at any given time. Once reviewed (approved or rejected), you may submit another.

5.3 Review Timeline

We aim to review all spot submissions within 48 hours of receipt. This is a target, not a guarantee. Review times may be longer during high volume periods.

5.4 Review Outcome

  • Approved — the spot becomes publicly visible on the map
  • Rejected — you will be notified and may resubmit with corrections
  • We do not guarantee that any submission will be approved

5.5 Multiple Spots

Users may submit as many spots as they wish over time, subject to the one-pending-at-a-time rule in clause 5.2.

5.6 Future Editing

We intend to build a user-facing dashboard allowing Users to view their submitted spots, check approval status, and request edits to approved spots. This feature is in development and not yet live.

5.7 Content Standards for Spots

Spot submissions must:

  • Represent a real, publicly accessible watersports location
  • Include accurate coordinates placed on the correct location
  • Contain honest, factual descriptions with no promotional language
  • Not infringe any third-party intellectual property rights
  • Not contain offensive, discriminatory, or unlawful content

6. Ratings

Registered Users may rate approved spots (1–5 stars per activity category). Ratings must reflect genuine experience. Fake, malicious, or commercially motivated ratings are prohibited and may result in account termination.

7. Business Listings (Paid)

7.1 Eligibility

Business listings are available to legitimate businesses in these categories:

  • Equipment Rental
  • Holiday Accommodation
  • Surf / Watersports School
  • Watersports Shop

7.2 Request Process

Business owners submit a listing request for review. We reserve the right to reject any business request without explanation.

7.3 Pricing

The current listing fee is £49 per year (or such other amount as published on the Platform). All fees are quoted inclusive of applicable VAT where required.

7.4 Payment Terms

  • Payment is required in full and in advance before the listing goes live
  • Listings become active upon confirmed receipt of payment
  • Payment methods are communicated directly upon agreement

7.5 Listing Term and Renewal

  • Each business listing is valid for one (1) year from the activation date
  • Before expiry, we will contact the business owner by email to offer renewal
  • It is the business owner's responsibility to ensure their contact email is current
  • If a listing is not renewed before the expiry date, it will be automatically removed with no refund

7.6 What the Listing Includes

  • A verified pin on the interactive Surfspots map
  • A business details page with name, description, images, contact info, website link, and category
  • Ability to update listing content via the admin process during the listing term

7.7 Content Standards

  • Accurate and not misleading
  • Related to genuine watersports or coastal activities
  • Free from offensive, discriminatory, or unlawful material
  • Compliant with applicable advertising standards (UK CAP Code, EU Directive 2006/114/EC)

7.8 No Refunds

All business listing fees are non-refundable once the listing has been activated, except where required by consumer protection law (see clause 13).

7.9 Platform Longevity

The surfspots.net domain is prepaid for a minimum of three (3) years. We commit to maintaining the Platform for at least that period. If we shut down permanently before a paid listing term expires, we will provide a pro-rata refund for the remaining unused months.

8. Intellectual Property

8.1 Platform Content

All platform design, code, branding, and non-user-generated content is owned by Dungeon Studio Solutions and protected by copyright. You may not reproduce, distribute, or create derivative works without prior written permission.

8.2 User-Submitted Content

By submitting a spot, rating, description, or image, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, reproduce, and distribute that content on the Platform and in promotional materials.

You retain ownership of your submitted content. You confirm that:

  • You have the right to submit the content
  • The content does not infringe any third party's intellectual property, privacy, or other rights
  • Any images submitted are either taken by you or you hold appropriate licences

8.3 Takedown Requests

If you believe content on the Platform infringes your intellectual property rights, contact us at surfspots.contact@gmail.com with "IP Takedown Request" in the subject line.

9. Safety Disclaimer

Important — Read Carefully

Spots listed on Surfspots.net are submitted by community members and are not professionally assessed or safety-certified. Conditions at any location can change rapidly due to weather, tides, seasonal variation, and other factors.

  • Always check current local conditions, tide tables, and weather forecasts before entering the water
  • Never watersport alone in remote or unfamiliar locations
  • Always wear appropriate safety equipment
  • Ratings and descriptions reflect community opinion, not professional safety advice
  • We accept no liability for accidents, injuries, or death arising from activities at any location listed on the Platform

Use the Platform at your own risk.

10. Prohibited Conduct

You must not:

  • Submit false, misleading, or fictitious spots or business information
  • Use the Platform to harass, defame, or harm other users
  • Attempt to gain unauthorised access to our systems or data
  • Use automated tools (bots, scrapers) to extract data from the Platform
  • Use the Platform for any unlawful purpose
  • Post spam, advertisements, or promotional content in spot descriptions
  • Impersonate another person or entity
  • Circumvent the one-pending-submission limit by creating multiple accounts

Violations may result in immediate account suspension and, where appropriate, referral to law enforcement.

11. Disclaimers and Limitation of Liability

11.1 "As Is" Service

The Platform is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

11.2 Accuracy of Information

We do not verify the accuracy of user-submitted spot descriptions, coordinates, or ratings. We are not responsible for decisions you make based on Platform content.

11.3 Limitation of Liability

To the fullest extent permitted by applicable law:

  • Our total liability to any user for any claim is limited to the amount paid by that user in the 12 months preceding the claim (or £50, whichever is greater)
  • We are not liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profit, loss of data, or personal injury

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

11.4 Third-Party Links

The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of those sites.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Republic of Ireland, without regard to conflict of law principles.

12.2 EU Users

If you are an EU consumer, you may also benefit from mandatory consumer protection laws of your country of residence that cannot be waived by contract.

12.3 UK Users

If you are based in the UK, these Terms comply with the UK Consumer Rights Act 2015 and applicable UK consumer protection regulations.

12.4 US Users

If you are based in the United States, any disputes not resolved informally shall be submitted to binding individual arbitration under AAA rules. Class action waiver: you waive any right to participate in a class action lawsuit or class-wide arbitration.

12.5 Informal Resolution

Before initiating formal proceedings, contact us at surfspots.contact@gmail.com. We will respond within 14 business days.

12.6 EU Online Dispute Resolution

EU consumers may use the European Commission's ODR platform at ec.europa.eu/consumers/odr.

13. Consumer Rights (UK & EU)

  • You may have statutory rights under the Consumer Rights Act 2015 (UK) or the EU Consumer Rights Directive
  • For digital services, you may have a 14-day right of withdrawal — however, because business listings are activated immediately upon payment, you expressly consent to early performance and acknowledge that the right of withdrawal is lost once the listing goes live
  • Nothing in these Terms affects your statutory rights

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the change takes effect. Continued use of the Platform after the effective date constitutes acceptance.

If you do not accept the new Terms, you may close your account before the effective date.

15. Termination

We may suspend or terminate your access to the Platform:

  • For breach of these Terms
  • If required by law or court order
  • If we reasonably believe your use poses a risk to the Platform or other users

Upon termination, your licence to use the Platform ends. Clauses relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Platform and supersede any prior agreements.
